SAN FRANCISCO, Jan. 5, 2013 /PRNewswire/ -- The following is being issued today by FISHMAN HAYGOOD PHELPS WALMSLEY WILLIS & SWANSON, L.L.P., ELLAINE CARR & ASSOCIATES, PLLC and SCHNEIDER WALLACE COTTRELL BRAYTON KONECKY LLP --

UNITED STATES DISTRICT COURT FOR THE EASTERN

DISTRICT OF LOUISIANA

If you worked for Grand Isle Shipyard, Inc., D&R Resources, LLC, or DNR Offshore and Crewing Services, Inc. in Louisiana, under E2 and/or B1/OCS visas, since November 8, 2008, a collective action lawsuit may affect your rights.

Present and former visa workers of Grand Isle Shipyard, Inc., D&R Resources, LLC, and DNR Offshore and Crewing Services, Inc. ("Defendants") in Louisiana have sued Defendants alleging, among other things, various violations of the Fair Labor Standards Act on behalf of themselves and all other similarly situated workers since November 8, 2008 (the "Class").

The workers have alleged that Defendants: 1) failed to pay them for all hours worked, including, without limitation, for time spent traveling to and from work and putting on and taking off protective equipment and tools at the beginning and end of the day; 2) failed to pay all wages owed to them, as a result of Defendants deducting certain expenses from the workers' wages, including, without limitation, expenses for housing and tools and equipment; and 3) failed to pay the federal minimum wage, as a result of Defendants deducting certain expenses from the workers' wages, including, without limitation, expenses for housing and tools and equipment.

DEFENDANTS DENY ALL ALLEGATIONS IN THE LAWSUIT. The Court has not made any determination regarding the merits of the lawsuit. But the Court has determined that the lawsuit should proceed as a conditionally certified collective action on behalf of the Class. A trial date has not been set.
