Bloomberg BNA And Baker & McKenzie Global Transfer Pricing Conference To Explore Critical Issues Facing Multinational Corporations In Light Of The BEPS Project

ARLINGTON, Virginia, Sept. 1, 2015 /PRNewswire/ -- Bloomberg BNA today announced that its Global Transfer Pricing Conference with Baker & McKenzie will feature a number of panels that outline potential pitfalls for the unwary in the soon-to-be-completed OECD/G20's Action Plan on Base Erosion and Profit Shifting (BEPS). The event is being held September 17-18, 2015 in Shanghai, China and is being co-organized by Vison Events. It will take place at the Jing An Shangri-La Hotel and registration is available here.   

Among the conference's ten panels are four topics that present critical challenges facing multinational corporations with global operations. 

"Implementation of Documentation and Country-by-Country (CbC) Reporting" will explore issues facing corporations and governments as they both gear up to deal with the looming new requirements to prepare, submit, and digest detailed transfer pricing documentation and CbC reports. Panelists from both Asian and US multinational corporations will share how their organizations are preparing to comply, challenges they are encountering, and the issues of most concern. A senior Asian government official will address how tax authorities expect to benefit from the new information, and what they see as the biggest challenges facing them in implementing data collection, in sharing information with other governments, and in meeting their confidentiality obligations. Attendees will also learn about continuing pressure in some jurisdictions for even greater transparency for corporate tax information, including pressure to make that information public.

"Management Fees: Are They Base Eroding Payments? Are OECD/G20 and UN Views Conflicting?" will feature Asia-Pacific tax practitioners discussing ways to avoid challenges in the area of management fees. Corporate and former government speakers will present their respective perspectives on whether management fees erode the tax base of the payer's jurisdiction or whether their absence erodes the tax base of the payee's jurisdiction. Attendees will gain new insights into this issue faced by multinational corporations. 

"The Future of IP Companies and Hub Structures" will focus on the importance of intellectual property (IP) to businesses, and the intense interest it receives from tax authorities. The BEPS Project does not spare IP from scrutiny and many of the Action Plan items impact IP, including the countering of harmful tax practices taking into account substance, the prevention of treaty abuse, and the need for transfer pricing outcomes to be in line with value creation. The panel speakers are experienced with IP hub structures and will share their views on how those structures may change under the BEPS Action Plan.

The "OECD/G20 BEPS Developments Regarding Risk and Recharacterization" panel of experts will explore one of the most fundamental questions in transfer pricing — the ability for multinational corporations to contractually allocate or reallocate risks among associated enterprises with the profits or losses attached to them. Given the most recent OECD/G20 thinking in this respect, panelists will discuss the extent to which the ability for tax administrations to disregard intragroup contractual arrangements may significantly increase. Representatives from two large US multinational corporations based in Singapore and Korea will share their experience about the practical challenges facing multinational corporations in the Asia Pacific region and how they prepare for the change.
