Taiwan Microloops Corp. Responds to the Patent Infringement Lawsuit Filed by Convergence Technologies Ltd. against it

TAIPEI, Taiwan, Nov. 24 /PRNewswire-Asia/ -- Taiwan Microloops Corp. today responded to the patent infringement lawsuit filed against it by Convergence Technologies Ltd. through Convergence's U.S. company Convergence Technologies (USA) LLC. Responding announcement made by Microloops follows.

Taiwan Microloops Corp. started developing and manufacturing Vapor Chamber since 2002. Its relevant basic theory is well known by the thermal industry. The focus of our company's own research and development has been with manufacturing process techniques and equipment for mass production. We also did many patent searches through professional patent offices to ensure we have not infringed intellectual property of others. Convergence Technologies Ltd. informed our company in April 2008 that it had obtained R.O.C. patent approval and asserted that our company had infringed upon its patent. Our company immediately hired the most authoritative firm RICH IP & Co. to investigate and confirmed that our company had not infringed upon such patent (For reference: http://www.microloops.com/document/Legal_opinion.pdf ). However, Convergence Technologies Ltd. did not agree with our view points and filed a lawsuit at the Taiwan Intellectual Property Court (Note 1) in September 2008. The trial lasted for one year. The Taiwan Intellectual Property Court ruled on 7 September 2009 that the patent infringement suit filed by Convergence Technologies Ltd. against Taiwan Microloops Corp. was rejected (For reference: http://www.microloops.com/document/Summary.pdf ). During the litigation period, both parties had sufficient opportunities and time to expand their viewpoints and arguments since there were as many as six court sessions for verbal arguments held. The court also finally ruled in favor of our company due to Convergence Technology Ltd's patents validity is questionable lacking novelty and inventiveness. The final ruling is Taiwan Microloops Corp. did not infringe upon the patent of Convergence Technologies Ltd.

The patent infringement lawsuit filed by Convergence Technologies Ltd. in the US is similar to the lawsuit in Taiwan in terms of unilateral determination of infringement of its patent by others. The US patent it referred to is similar to its patent in Taiwan. Our company already had sufficient evidence against its lawsuit in the patent litigation in Taiwan. In the same manner as the decision by the Taiwan Intellectual Property Court, we are sure that our company will receive a favorable decision from the US Court.

Our company has always been respecting intellectual property right laws and has never infringed upon others' patent. However, facing untruthful assertion, we will surely take the most proactive legal action to protect the interests of our company. Convergence Technologies Ltd. has used virtually the same patent in Taiwan to file patent infringement again against our company and our clients in different jurisdiction, which is totally unacceptable to us. Our company will take the most protective legal measures to protect the interests of our company and our clients.

Note 1: The protection system adopted by the Taiwan Intellectual Property Court is similar to that of advanced countries in the world. The count was established in July 2008 and is a professional and authoritative intellectual property court. The trial and decision of cases meet with the procedures and standards of those of advanced countries.
