BMC to protect its rights in patent fight with ResMed

BEIJING, December 12, 2013 /PRNewswire/ -- BMC Medical Co., Ltd (BMC) is a specialist of sleep diagnosis and therapy and headquartered in China. On 11 November 2013, right before the commencement of the MEDICA trade show in Dsseldorf, Germany, ResMed filed applications for preliminary injunctions against BMC with the District Court Munich I, Germany, prohibiting BMC from selling or marketing certain products in Germany including BMC's RESmart CPAP devices and BMC's Willow/FeaLite nasal pillows.

Dr. Ulrich Worm, head of IP Germany and Partner of global law firm Mayer Brown, retained by BMC to represent BMC in the patent fight, points out: "The preliminary injunctions are issued as a result of ex parte proceedings, which means that the court did not hear, and could not take into account of, BMC's side of the story. Until now, no court hearing has been conducted."

James Xu, General Manager of BMC, states: "We will take all the measures required to defend our IP and products, thus protecting our consumer and business interests against the preliminary injunctions."

In the same vein, in July of this year, ResMed initiated two legal proceedings in the U.S. at the ITC and the Federal District Court of Southern California, alleging that BMC infringed its patents. BMC has retained a noted ITC 337 and patent specialist, Gary Hnath of Mayer Brown to fully contest the proceedings. Gary Hnath has indicated that he is confident that BMC will be able to demonstrate that each patent asserted by ResMed in the U.S. is either not infringed, invalid, or both.
